1. Acceptance of Terms

By downloading, installing, or using Enter-Comm ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Enter-Comm is a mobile application that enables push-to-talk voice communication between devices using WiFi Direct mesh networking. The App allows users to:

• Create and join private communication groups
• Communicate via push-to-talk voice
• View group member locations (with GPS enabled)
• Communicate without internet or cellular connectivity

3. Eligibility

You must be at least 13 years old to use Enter-Comm. If you are under 18, you should review these Terms with a parent or guardian to ensure they understand and agree to them.

4. User Responsibilities

When using Enter-Comm, you agree to:

• Use the App in compliance with all applicable laws and regulations
• Not use the App for any illegal, harmful, or malicious purposes
• Not transmit content that is threatening, abusive, harassing, or hateful
• Not interfere with or disrupt the App or other users' enjoyment
• Not attempt to gain unauthorized access to other devices or networks
• Take responsibility for all activity that occurs through your use of the App

5. Acceptable Use

Enter-Comm is intended for legitimate group communication purposes, such as:

• Outdoor recreational activities (riding, hiking, skiing, etc.)
• Event coordination and group management
• Emergency communication in areas without cell service
• Team communication during activities

5.1 Prohibited Uses

You may not use Enter-Comm to:

• Conduct illegal activities or plan unlawful acts
• Harass, threaten, or harm other users
• Transmit obscene, offensive, or inappropriate content
• Violate the privacy or rights of others
• Interfere with emergency communications or services
• Impersonate others or misrepresent your identity

6. Intellectual Property

Enter-Comm and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. Disclaimer of Warranties

Enter-Comm is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the reliability of communication range or quality
• Warranties that the App will meet your specific requirements

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or use
• Personal injury or property damage
• Communication failures or interruptions
• Any damages arising from your use or inability to use the App

9. Indemnification

You agree to indemnify and hold harmless Enter-Comm, its developers, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Content you transmit through the App

10. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

11. Changes to Terms

We may revise these Terms from time to time. The most current version will always be available within the App and on our website. By continuing to use Enter-Comm after changes become effective, you agree to be bound by the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Enter-Comm regarding your use of the App and supersede any prior agreements.
